One Leg Stand Test

The “One Leg Stand” test is one of the three field sobriety tests standardized by the National Highway Traffic Safety Administration.

The subject should be instructed to stand with her feet together and arms down to her side.  The subject is then instructed to stand on one leg while holding the other foot approximately six inches off the ground.  The elevated foot is supposed to be pointed forward, approximately parallel to the ground.  This position is to be maintained for approximately 30 seconds and the subject may be instructed to count to thirty (one thousand one, one thousand two, one thousand three, etc.).  The subject is supposed to keep his arms at his sides at all times and watch the elevated foot.  The officer is supposed to demonstrate the test during the instruction phase.

A point could be scored against the subject for the following reasons:

* the subject sways;

* the subject raises her arms more than six inches away from her body;

* failure to follow instructions (such as counting properly or watching the elevated foot); or

* hopping on the anchor foot.

As with the other Field Sobriety Tests, this test is far from 100% reliable in determining intoxication.  In fact, it has been shown that the test is only 65% accurate in determining whether a person’s BAC is above .10.  This test combined with the Walk and Turn test is only 80% accurate!

As with the other tests, many factors can impede a subject’s ability to pass this test.  Examples are:

* age and athletic ability;

* obesity;

* footwear such as high heels;

* injuries, disabilities, and other medical conditions;

* lighting;

* weather;

* traffic; and

* whether the surface is level.

Mr. Holcomb is well-prepared to litigate whether your One Leg Stand Test was properly administered, and whether the results were accurate and/or properly interpreted.
